On December 28, 2009, at approximately 6:47 pm, while on West Fifth
Street North near Hannibal Street in the City of Fulton, State of New York,
the defendant, Kristy M. Burdick, was arrested for aggravated unlicensed
operator in the third degree and operating a motor vehicle while the
registration was suspended.
On December 28, 2009, at approximately 6:36 pm, while in the 500 block
of Hannibal Street in the City of Fulton, State of New York, the said defendant
did operate a motor vehicle in an easterly direction while knowing that her New
York State drivers license was suspended for failing to answer two summons
in the Town of Volney Court. Furthermore, the said vehicle's registration was
found to be suspended on 12/21/2009 for insurance lapse.

On 12/31/09 at approximately 6:51 PM, while on SR 481 at Riverglen
Plaza, in the City of Fulton, County of Oswego, State of New York, the said
defendant, Joseph J. Kelliher, was arrested for the offenses of driving while
intoxicated, driving while ability impaired by drugs, and unsafe lane change.
It is alleged that on the aforementioned date, at approximately 6:33 PM,
while at the aforementioned location, the said defendant operated a motor
vehicle, in a northerly direction on SR 481 just south of Riverglen Plaza.
While doing so, the defendant made an unsafe lane change, and struck
another vehicle stopped at the traffic light at the intersection. Said accident
resulted in the driver of the other vehicle being transported to the hospital
for pain and a possible concussion. It is further alleged that the defendant
operated said vehicle while in an intoxicated condition. The defendant
swayed while standing still, had impaired motor coordination, and slow,
slurred speech. The defendant was also disoriented and confused as
to where he was. The defendant admitted that he had taken several prescribed
medications prior to driving. I had the defendant perform three field sobriety tests.
The tests performed were reciting the alphabet, the walk and turn test, and the
one leg stand. The defendant failed all three tests. He was taken into
custody and transported to the police department. The defendant agreed to
supply a breath and blood sample for chemical analysis. A breath sample
taken at the police department showed the defendant's blood alcohol content
was 0.00%. The defendant was transported to Oswego Hospital, where he
supplied a blood sample for chemical analysis. Said sample was secured as
evidence, and will be later processed at the New York State Police
Laboratory.
